GMB Manager and TBS provide digital marketing services.

Throughout these Terms & Conditions TBS shall be referred to ‘The Provider’ or ‘Us’. You, the customer shall be referred to as ‘The Customer’ or ’You’.

Digital Marketing Services

The digital marketing services offered, include but not exclusively, website design, on-page SEO, Local SEO optimisation and other related services detailed on the website will be referred to as ‘Digital Services’.

TBS will comply with UK data protection law and adopt any legally established measures to safeguard users’ personal details, avoid alteration of user generated content and un-authorised access to the site, in so far as the technology permits.

TBS treats the security of its site as of the utmost importance. TBS is constantly considering ways in which it can safeguard the personal details of users, prevent un-authorised access to the TBS site and prevent un-authorised alteration of user-generated content.

It is the right of TBS to cancel your website and suspend it from access in the event we have good cause to believe any of the details mentioned above are found to be untrue or inaccurate.

Warranties and Guarantees

TBS cannot be held responsible for any performance related issues with Local SEO, including Google My Business and Bing Local rankings and your website’s accessibility on the internet. No guarantees at all are offered as to where any website in our control may be found on the internet and any work to achieve this is the sole responsibility of the customer. TBS accepts no responsibility for the performance of any listing and cannot guarantee any subsequent increase in sales or enquiries.

TBS accepts no responsibility for any losses either actual or consequential that are based on a Digital Services We provide.

Termination

It remains the right of the Provider to remove any website in our control from the internet that contravenes any of these Terms & Conditions. Should any payment be missed or related the standing order or Direct Debit is cancelled the provider shall be within its rights to suspend the website from the internet. No responsibility shall be placed on the provider to retain any information whilst it is suspended.

Limitation of Liability

The website is provided on an “as is” and “as available” basis. As a consequence, TBS makes no representations or warranties, and hereby excludes all warranties, express or implied, as to:
the quality, accuracy, feasibility or credibility of the content of the TBS sites;
the availability, quality or fitness for any particular purpose of any of the services available on the TBS sites;
the availability, suitability, quality or fitness for any particular purpose of any of the goods, services or other matters that are discussed, criticised or are otherwise the subject of any opinion published anywhere on the TBS sites;
the website being free from infection by viruses or anything else that has contaminating or destructive properties.

Supplied information

All information supplied by You, The Customer is accepted by TBS in good faith and it is the sole responsibility of the Customer to ensure it is accurate, up to date and not misleading. Any images used in a website in the control of TBS. are held for this reason alone. TBS accepts no responsibility in the storing of and management of any photograph, text and images supplied to us.

Privacy

TBS takes your rights to privacy very seriously and will only collect information for its own purposes such as for billing and login details. The details you supply will not be used for anything other than the good running of your website and will not be sold, rented or leased to any third party. Completion Dates

All dates for completing any Digital Services purchased by You are given as guidance only. TBS will not be held responsible for any consequential losses suffered as a result of late delivery.

Preparatory Work

Any preparatory work undertaken by TBS will be charged to You if the order is cancelled at any time before competition. This will include copy written text, design, artwork, image acquisition and time spent preparing proofs and visuals.

Proof Approval

We will provide you with proofs that will be accurate for content and layout and will endeavour to ensure that all artwork and designs are correct at this stage. However, it is your responsibility to check that there are no spelling errors, mistakes or omissions and that you are fully satisfied with proofs layout and content. Once a proof has been approved, if errors are subsequently found, any remedial work will be carried out at your cost.

Jurisdiction and Applicable Law

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
